Terms and Conditions

  1. The Contract
    When you purchase travel services and packages from Accessible Escapes, you are acknowledging that you understand and have accepted the information we provided you regarding your purchase. You are also accepting that our terms and conditions form the basis of the contract between Accessible Escapes and you. The purchaser must confirm that he/she has the authority of all the persons included in the vacation to make the reservation on their behalf. The person who makes the reservation accepts responsibility for making payments to Accessible Escapes for all members of the party and will receive all documents and other information from us on behalf of the party.
  2. Making A Reservation
    A provisional reservation will be accepted by telephone, fax or email, which will be held for an agreed period by Accessible Escapes. This reservation will be confirmed in writing by Accessible Escapes upon receipt of appropriate deposits and/or balance payments. Please check the invoice carefully to ensure that it is correct and let us know immediately if you notice any discrepancies.
  3. Payment
    When you purchase a vacation package, product or service from Accessible Escapes, you pay for the item in full at the time of purchase. For your protection, we ask that anyone who books travel through Accessible Escapes purchase and maintains comprehensive travel insurance. This policy must include cancellation coverage; 24-hour medical and emergency service, repatriation and a 24-hour emergency telephone help line. Travelers should provide details of their insurance to Accessible Escapes 30 days prior to departure. Please make sure the insurance covers any pre-existing medical conditions (past and present) and check for any exemptions. If you are bringing a wheelchair, please ensure that it is covered in the policy. When you purchase an Accessible Escapes vacation, you agree to purchase and maintain this travel insurance for the duration of your trip.
  4. Amendments
    Until your reservation has been confirmed, we reserve the right to make any necessary changes. You will be informed immediately of any changes to your reservation. After your reservation is confirmed, we will take reasonable steps to make any requested changes.
  5. Cancellation By You
    You may cancel your vacation at any time. Cancellations must be done in writing by the person who made the reservation. The date of cancellation is the date the letter is received in this office. When you purchase a vacation with Accessible Escapes, you pay for the tour in full at the time of purchase. Due to the fact that we have to pay many of our vendors in advance, cancellation fees will apply based on the number of days before departure we receive your cancellation letter.More than 2 months - 10%
    Between 35 days and 2 months - 40%
    Between 22 days and 34 days - 70%
    Between 14 days and 21 days - 90%
    14 days and less - 100%If you cancel for a reason covered by your insurance policy, we advise that you make a claim with the insurance company.

    If you have purchased a vacation package for multiple people and a cancellation affects the number of people who will travel, we will recalculate the invoice based on the number of people actually travelling. No refund will be given on any unused portion of the reservation.

  6. Cancellation/Alteration By Us
    We reserve the right to make changes to your reservation if absolutely necessary. Most changes are minor, such as a hotel change within the same category of service or a change to/cancellation of an event (such as an excursion) at your destination. We will notify you of changes as soon as possible but we do not pay compensation for minor changes.If we have to make a major change such as an alteration to the departure time of your transport or a change of accommodation to a lower category, we will inform you immediately and refund any price difference.

    In the event of a major change, you will be entitled to compensation as detailed in the paragraph above, unless the change or cancellation is caused by circumstance beyond our control, such as bad weather, airport closures, industrial action, hotel closures, epidemic, civil strife , labor strikes, or terrorist activity, fire, flood, war, threat of war, natural or nuclear disaster.

    *Important note: In respect of all vacations booked, Accessible Escapes will not be responsible for any out-of-pocket expenses or consequential or indirect loss you incur as a result of any change. We will not pay you any compensation if you have not paid the full amount for your vacation 60 days before departure. In the event of a change to an accommodation only reservation, Accessible Escapes will be liable only in relation to the accommodation booked and we will not be responsible for any indirect costs or losses or other out-of-pocket expenses incurred.

  7. The Price
    All prices are correct at the time of publication but are subject to change if full payment has not been received 60 days in advance.
  8. Descriptions
    All descriptions of properties and services are made in good faith and every care is taken to ensure their accuracy. However, owners of properties, amenities, tourist sites, activities may change their services from time to time and without notice and Accessible Escapes shall not be responsible if amenities mentioned on the website are not available. We notify you of changes of which we become aware prior to departure. If we are aware of building work or unusual noise at the hotel you will be advised before departure.

    All accommodations listed on our website have been inspected by Accessible Escapes to assure that the accommodation is suitable for use by a wheelchair user or “slow walker.” However, abilities vary considerably and it is your responsibility to make known to Accessible Escapes all special requirements you have. See Paragraph 13. Accessible Escapes will not be responsible for any changes to the properties or their contents after the date of inspection.

  9. Travel Insurance
    For the protection of your party, it is a condition of reservation that all members must take out a COMPREHENSIVE TRAVEL INSURANCE policy. This policy must include cancellation coverage; 24-hour medical and emergency service, repatriation and a 24-hour emergency telephone help line. Clients arranging their own insurance must do so immediately thereby covering for the possibility of cancellation and subsequent loss of monies. Clients must provide details of their insurance 60 days prior to departure and maintain coverage for the duration of their trip.
  10. Vacation Accommodations
    All villas, hotel and apartment accommodations are privately owned and Accessible Escapes acts as an agent for the owners or their representatives. Only those persons named at the time of reservation may occupy the property. Breakages or damage must be reported to our local agent immediately and the appropriate payment or replacement made locally before departure. We will require a credit card number as security. If there has been a breakage or damage at a villa, hotel or apartment, a claim may be made against you for the full cost of any replacement items or repairs. We reserve the right to charge for any breakage or damage which is discovered after you have vacated the property and which has not been reported.
  11. Flight Arrangements By Third Parties
    Scheduled flights and some other services are subject to the terms and conditions of the carriers, some of which may limit liability. Should you be advised of any changes to flight schedules by the airline, tour operator or consolidator, you must inform us immediately in order that appropriate arrangements can be made for your arrival at your destination. Important note: Aircraft types are subject to change without notice by the airlines.
  12. Claims & Liability
    Any claim under this agreement shall be subject to American Law and all proceedings shall be within the exclusive jurisdiction of the American Courts. As part of our undertaking to provide your required vacation arrangements, it is necessary for Accessible Escapes to select and make arrangements with various independent contractors including hoteliers and coach transport operators. Accessible Escapes is not responsible or liable for the negligence or other acts or omissions of those independent carriers, the hoteliers or other contractors, or their employees or agents.
  13. Special Requirements
    Whenever possible, we will provide pictures, measurements and descriptions of all hotel rooms so you are able to decide if the accommodation is appropriate for your needs. If you need additional information or have specific dietary requests, please inform Accessible Escapes at the time of your booking. We will accommodate your needs as best we can and keep you informed of any issues regarding your requests.
  14. Data Protection
    In order to process your reservation, it is necessary for us to collect personal data from you and members of your party. In order to arrange your vacation, we may have to pass some of that information on to the relevant suppliers of your travel arrangements. Such suppliers may be outside the United States. We may contact you or members of your vacation party in the future to inform you about our services. Please let us know if you do not wish to receive such information in the future. By signing the reservation form you confirm your consent to the use of your data and that of your party members for these purposes.
  15. Complaints
    If you have a complaint about your vacation, please report it to our local guide or concierge and/or Accessible Escapes via the emergency telephone number immediately. If you fail to do this, we cannot accept responsibility as we may have lost the opportunity to investigate and rectify the problem. You must also write to Accessible Escapes within 30 days of your return with full details of your complaint.
  16. Locally Hired Equipment & Facilities
    Upon request, Accessible Escapes will make arrangements on your behalf to rent equipment or hire medical services such as wheelchairs, nursing, oxygen supplies or dialysis when possible. Accessible Escapes accepts no responsibility for ensuring that this equipment or these services will be available for you or will be suitable for your requirements. Unless otherwise stated, you will be responsible for paying the local supplier and you should ensure that you take sufficient local currency for this purpose. Any loss or damage caused by the equipment which you hire or services provided to you will be the responsibility of the local supplier; Accessible Escapes accepts no responsibility for the selection or fitness for purpose of the equipment or services supplied or for any loss or damage caused by its use.
